1. Introduction
Welcome to SharedInformationSquare ("we," "us," or "our"). These Terms & Conditions ("Terms") govern the use of our boating services and the website found at sharedinformationsquare.site (the "Service") provided by SharedInformationSquare.
By reserving a charter or using our Service, you consent to adhere to these Terms. Should you not agree with any part of these terms, you are not permitted to use the Service.
2. Service Overview
SharedInformationSquare offers high-end yacht charter services, which include:
- Rental of yachts for daily use
- Evening boat tours
- Company retreats
- Exclusive events
- Extended charters spanning multiple days
All our services are dependent on availability and local weather conditions. We retain the right to adjust or discontinue services when necessary.
3. Booking and Reservations
3.1 Booking Process
To reserve a yacht, you are required to:
- Be of at least 18 years of age
- Submit true and complete information
- Deposit the amount indicated in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A reservation is considered confirmed only after payment is received and we have issued a written confirmation. We reserve the right to deny service at our discretion.
3.3 Availability
Charter availability is contingent upon boat availability and favorable weather conditions. We endeavor to accommodate your scheduling preferences to the best of our ability.
4. Payment Conditions
4.1 Pricing
Prices are provided in € and include all applicable taxes unless otherwise indicated. Prices are subject to change without prior notification.
4.2 Payment Schedule
- Initial deposit: 50% of the full charter cost, payable upon booking
- Remaining balance: Payable 48 hours prior to the charter's departure
- Incidental fees (if any): Payable upon the charter's completion
4.3 Methods of Payment
Accepted forms of payment include major credit cards, bank transfers, and certified cheques. Payment processing is conducted using secure, encrypted methods.
5. Cancellation and Refund Policy
5.1 Client Cancellations
- If canceled more than 72 hours before departure: Full refund minus processing charges
- If canceled between 24 to 72 hours before departure: 50% refund
- If canceled less than 24 hours before departure: No refund will be issued
5.2 Cancellations Due to Weather
If the captain deems weather conditions as unsafe, we will suggest to:
- Reschedule your charter to an alternative date without additional costs
- Issue a full refund if it is not possible to reschedule
5.3 Mechanical Failures
If the assigned vessel encounters mechanical issues, we will attempt to provide a comparable substitute. If no replacement is available, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Regulations
All guests must:
- Obey all instructions given by the crew
- Wear any provided safety gear as required
- Disclose any medical conditions that could impact their safety
- Stay within designated areas on the vessel
6.2 Prohibited Items
The subsequent items are prohibited onboard:
- Glass containers
- Contraband substances
- Guns or other weapons
- Excessive consumables beyond what is deemed reasonable
- Pets (unless approval has been obtained in advance)
6.3 Guest Behavior
Guests must conduct themselves respectfully. We reserve the right to terminate a charter without a refund if a guest's conduct endangers safety or negatively affects others' experience.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the charter amount paid by you. We are not responsible for:
- Injuries incurred due to guest negligence
- Theft or damage to personal belongings
- Indirect or punitive damages
- Delays stemming from weather or situations out of our control
7.2 Insurance
We maintain comprehensive insurance that covers our vessels and operational activities. It is the responsibility of passengers to secure their own travel and personal insurance.
7.3 Assumption of Risk
By engaging in our charter services, you recognize the inherent risks associated with seafaring activities and accept personal responsibility for your safety and welfare.
8. Changes to Itineraries
We reserve the right to adjust itineraries, routes, or schedules for reasons such as weather conditions, safety concerns, or operational necessities. We will make every effort to offer a service of equivalent value.
9. Force Majeure
We are not accountable for any delays, cancellations, or changes instigated by events outside our control, such as:
- Extreme weather events
- Natural catastrophes
- Government impositions
- Port closures
- Vehicle malfunctions
10. Privacy and Data Management
Your personal data is managed in line with our Privacy Policy. Utilization of our services signifies your agreement to our data collection and usage as detailed in the Privacy Policy.
11. Ownership of Content
All content displayed on our website, such as text, imagery, and trademarks, is protected by copyright and intellectual property laws. You are prohibited from copying, distributing, or generating derivative works without our explicit consent.
12. Jurisdiction
The applicable laws of Spain govern these Terms. Legal disputes will be addressed in the courts of Barcelona, Spain.
